SMS Terms & Conditions

These SMS Terms & Conditions ("SMS Terms") govern text messages sent by or on behalf of TotusTix LLC ("TotusTix," "we," "us," or "our") to a mobile telephone number you provide. They supplement and are incorporated into the TotusTix Terms of Use and Privacy Policy. By enrolling in a TotusTix SMS program, you agree to these SMS Terms. If these SMS Terms conflict with the general Terms of Use solely with respect to SMS messaging, these SMS Terms control.

1. Program Description and Message Categories

1.1 Transactional and Service Messages

If you choose to receive SMS communications concerning an order, TotusTix may send order confirmations, ticket-delivery or access links, authentication or security messages, customer-service communications, and time-sensitive Event updates such as cancellations, postponements, schedule changes, venue changes, entry instructions, or other information reasonably necessary to service your transaction. Transactional consent does not constitute consent to receive marketing messages.

1.2 Marketing Messages

If you separately and affirmatively opt in to marketing SMS, TotusTix may send recurring automated or non-automated promotional messages concerning Events, presales, ticket offers, announcements, reminders, and other TotusTix products or services. Marketing SMS consent is voluntary and is not a condition of purchasing tickets, creating an account, or receiving services.

2. How Consent Is Obtained

Where SMS consent is requested online, TotusTix will use a clear and conspicuous disclosure presented with an unchecked checkbox, toggle, or comparable affirmative mechanism. SMS consent will be separate from any required acceptance of the Terms of Use or Privacy Policy. TotusTix may maintain records of the consent language presented, the date and time of consent, the telephone number, the applicable messaging program, and other information reasonably necessary to demonstrate consent.

Consent applies only to the TotusTix messaging program and category for which it was provided. Consent is not transferable to a different sender or materially different messaging campaign without any additional consent required by applicable law or carrier rules.

3. Marketing Opt-In Disclosure

The following disclosure, or substantially equivalent language approved for the applicable messaging platform, should appear immediately adjacent to any marketing SMS opt-in control:

"Yes, I agree to receive recurring automated marketing text messages from TotusTix at the mobile number provided, including Event announcements, presales and offers. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. See the TotusTix Privacy Policy and SMS Terms."

4. Message Frequency and Charges

Message frequency varies based on the program, your activity, the Events you follow or purchase, and the communications you request. TotusTix does not impose a separate charge for SMS messages, but message and data rates may apply under your wireless plan. Your wireless carrier may impose other charges.

5. Opting Out and Revoking Consent

You may revoke consent and opt out of a TotusTix SMS program at any time by replying STOP to a message from that program. Where supported, equivalent customary opt-out keywords may also be honored. TotusTix will process reasonable revocation requests in accordance with applicable law and carrier requirements.

After a valid STOP request, you may receive one final message confirming that your opt-out has been processed. TotusTix will not send further messages from the opted-out marketing program unless you later provide new consent. Opting out of marketing does not automatically cancel a separate transactional or service-message program for which you have independently enrolled; however, you may revoke consent for that program as well. TotusTix will honor any applicable request not to receive further outbound text messages.

6. HELP and Customer Support

Reply HELP to a TotusTix SMS message for available assistance. You may also use the customer-support contact information published on TotusTix.com. Support availability and response times may vary by Event and issue.

7. Carriers; Delivery; Availability

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and/or messaging provider and is not guaranteed. SMS service may not be available on all carriers, devices, or in all locations. TotusTix may add, change, suspend, or discontinue an SMS program or sender number at any time, subject to applicable law.

8. Mobile Number Ownership and Responsibility

You represent that you are the subscriber or customary user of the mobile number you enroll, or that you are authorized to consent to messages at that number. If you change, transfer, deactivate, or relinquish your mobile number, you should opt out before doing so and update your TotusTix account information promptly. You agree not to enroll a number belonging to another person without authorization.

9. Privacy and Mobile Information

TotusTix handles personal information associated with SMS communications in accordance with the TotusTix Privacy Policy. Mobile telephone numbers, SMS opt-in data, and SMS consent records will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. TotusTix may disclose information to service providers and messaging vendors solely as reasonably necessary to operate, secure, support, or comply with the SMS program, subject to appropriate contractual and legal restrictions.

10. Compliance; Automated Messaging

TotusTix intends to operate its SMS programs in accordance with applicable federal and state law, including applicable provisions of the Telephone Consumer Protection Act and Florida telephone-solicitation law, as well as applicable wireless-industry and messaging-provider requirements. Where prior express written consent is legally required for an automated marketing text, TotusTix will seek such consent before sending that text.

11. Changes to These SMS Terms

We may revise these SMS Terms from time to time. The revised version will be posted with an updated effective date. Where applicable law requires additional notice or renewed consent for a material change to a messaging program, TotusTix will provide it.

12. Governing Law; Relationship to General Terms

These SMS Terms are governed by the governing-law and dispute-resolution provisions in the TotusTix Terms of Use, including the application of Florida law and the agreed venue in Miami-Dade County, Florida, except to the extent federal law or another non-waivable law controls. Nothing in these SMS Terms expands any right or remedy beyond what applicable law requires.
